Bptp Ltd Complaints - Bptp Ltd. Delay in delivery of plot Complaint

I am the owner of Plot no. L12 -22, at BPTP Parklands, Faridabad, Haryana, project of BPTP Ltd.

I had visited the office of BPTP at BPTP Limited, M-11 Middle Circle, Connaught Place, New Delhi - 110001 and at BPTP Limited ,BPTP Crest, Plot # 15, Udyog Vihar Phase-IV, Gurgaon -122 015, Haryana, approx 12 times to have the status of possession of plot during last 1 year.

I had the meeting or discussion with customer care of BPTP and they had not provided me in writing the plan for possession of my above said plot. They had always given the single oral reply that the possession of plot will be provided in next 6-8 months.

I had also approached to your staff by e mail. However, I had not received any plan for hand over of passion of my plot by e mail.

I had also visited the site of BPTP Parklands, Faridabad, Haryana. I had found that the work had been done upto the extend demands for projects had been paid.

I like to bring your attention to -

(i) Clause no 22 of “Plot Buyer’s Agreement” of BPTP Parklands, Faridabad, Haryana which had been singed on 1st July 2008. Accordingly to that clause, the possession of plot shall be delivered by the company within 24 months from sanctioning of the service plans of the entire colony.
(ii) Schedule I of “Plot Buyer’s Agreement” of BPTP Parklands, Faridabad, Haryana which had been singed on 1st July 2008. According to that schedule, I had already paid upto 95% of Basic Sale Price paid on 18th November 2008. Therefore, it means that the company had already finished the following jobs –

a. Marking of Roads.
b. Marking of Plots
c. Development of Parks
d. Laying of Water and Sewer lines
e. Laying of Roads

Hence, after completion of above said activities, the plot should be ready for possession.

(iii) I had received a letter from your company for change in plot no and location from LM08-03 to L12-22 on 16th November 2008. According to that letter the location of plot had been changed arbitrarily without my consent. The bank had also done the due diligence for plot no. LM 08-03 at the time load approved to me for purchase of plot. As per Clause no 07 of “Plot Buyer’s Agreement” of BPTP Parklands, Faridabad, Haryana which had been singed on 1st July 2008, the plan can only changed in case required by statutory authority of Government. The above said change in location of plot had been done without providing the reason and supporting document for change.

I had written a email on 19th Aug’11 on mail address Kabul.chawla@bptp.com which has been provided by customer care, BPTP. I had not received any reply.

However, I had received a letter on 26th Aug’11 which dated 19th Aug’11. In this letter intimation had been given that the previous plot allotted to me had been changed due to change in layout plan and new plot no is Z3 -12A along with 3 copies of addendum for plot no. 12-12 and Z3-12A. The plot had been changed arbitrarily without my consent and same is illegal and not acceptable to me.

I am requesting you to provide guidance for further perusal of case in order to receive the possession of my plot L12-12.
